1 These terms
1.1 These terms apply to your use of the New Zealand Vessel Register website (the "website"), which is operated by NZBP Limited, NZBN 9429053933454 ("we", "us", "our"). By using the website, you agree to these terms.
1.2 We may change these terms without notice by publishing a new version. The date above is the date of the current version, and a change applies to use of the website from that date.
1.3 In these terms, "record" and "public record" have the meanings given in our service terms, and "including" means including without limitation.
2 Applications
2.1 An application submitted through the website is governed by the service terms accepted with it. The agreement for an application is set out in clause 1.2 of the service terms, and where these terms differ from the service terms, the service terms apply to that application.
3 Use of the website
3.1 You may use the website and the public records on it for any lawful purpose. You must not:
(a) seek unauthorised access to the website or its systems;
(b) interfere with the operation or security of the website;
(c) upload or send viruses or other harmful code;
(d) copy public records in bulk, by hand or by automated means, without our written consent;
(e) misrepresent a record, a plate, a person named on a record, or any connection with us; or
(f) use the website in breach of any law.
3.2 We may suspend or block access to the website by any person who breaches clause 3.1, where reasonably required to protect the website and its records.
4 Reliance on records
4.1 What the New Zealand Vessel Register and an entry on it are, what an entry records and what it does not are stated in clauses 2.2, 2.8 and 5.1 of the service terms.
4.2 A registration or public record does not take the place of safe operation and maintenance, a pre-purchase inspection, any certificate the law requires, or professional advice for your circumstances, and does not affect any person's obligations under the law.
5 Website content
5.1 Unless we state otherwise, the content of the website is owned by or licensed to us. Except as clause 5.2 allows, you must not copy, adapt, distribute or make commercial use of it without our written consent.
5.2 You may view, download or share a single public record to check a vessel, or in connection with its ownership, sale or insurance, if you do not alter it or present it in a misleading way.
5.3 Data licensed to us is attributed as its licence requires:
- Sourced from the LINZ Data Service and licensed for reuse under CC-BY 4.0.
- Contains place names from the New Zealand Gazetteer, Toitū Te Whenua LINZ, licensed for reuse under CC-BY 4.0.
- Source: Stats NZ and licensed by Stats NZ for reuse under CC-BY 4.0.
- This work is based on/includes MPI data which is licensed by Ministry for Primary Industries (MPI) for re-use under the Creative Commons Attribution 4.0 International licence.
6 Availability and liability
6.1 To the extent permitted by law, we do not warrant that the website or any public record will be available at any particular time or for any particular period, that either will be uninterrupted or free from error, or that information supplied by another person is complete or current. We may suspend, change or discontinue the website where reasonably required to maintain, secure or develop it.
6.2 To the extent permitted by law, we are not liable for any loss of profit, revenue, opportunity or use, or for any indirect or consequential loss, arising out of or in connection with use of the website, inability to use it, or reliance on it.
6.3 Nothing in these terms limits any right or remedy under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be limited.
7 Other organisations and links
7.1 The website may name or link to other businesses and professionals. Unless we state otherwise, they are independent of us, and we are not responsible for their websites or the services they provide.
8 Privacy
8.1 We handle personal information in accordance with our privacy policy and the Privacy Act 2020.
9 General
9.1 If any provision of these terms is unenforceable, it is read down to the extent necessary, or severed, and the remaining provisions continue in effect.
9.2 These terms are governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction.
